Terms of Use

1.1. These Terms of Use govern the legal relationship between FMA Estonia OÜ (registry code 16957616) and the User when using the http://www.findmyaccountant.eu/en portal.

1.2. Terms and definitions used in these Terms of Use:

1.2.1. http://www.findmyaccountant.eu/en :

http://www.findmyaccountant.eu/en is an online portal owned by FMA Estonia OÜ, which allows Users to submit Requests for accounting and/or business consulting services, make and compare Offers, select the Request Winner, and communicate with other Users.
Users can act as both service requesters (Client) and service providers (Accountant) on the portal.

1.2.2. User:

A User is a natural or legal person using the http://www.findmyaccountant.eu/en portal. Users are categorized as:

• Client – a User submitting Requests for accounting and/or business consulting services;

• Accountant – a legal entity that has registered a User account and responds to Client Requests with offers.

1.2.3. User Account:

A User Account is created on the http://www.findmyaccountant.eu/en portal and allows an Accountant to manage their Service Provider Profile, respond to Requests, and use other portal features according to the selected service package. Registration requires company name, registry code, VAT number (if applicable), address, contact phone number, and email address.

1.2.4. Service Provider Profile:

An Accountant’s User Account includes a Service Provider Profile containing information about the provider’s services, skills, and experience.
The Service Provider Profile and its contact information are not public.
Accountants can set preferences for notifications and Requests on their profile.

1.2.5. Request:

A Request is an anonymous summary of information, preferences, and conditions submitted by the Client. Based on the Request, the portal matches suitable Accountants considering their experience, skills, resources, pricing, and ratings.

1.2.6. Offer:

An Offer is a quotation submitted by an Accountant in response to a Client Request. The conditions of the Offer are determined by the Accountant. A Client sees up to five most suitable Accountants based on their Request. All Offers remain anonymous; only the information in the Service Provider Profile is shown without name or contact details.

1.2.7. Request Winner:

The Request Winner is the Accountant whose Offer has been selected and confirmed by the Client.
The Client’s contact details are provided to the Request Winner immediately after the Client has confirmed the Request Winner.

1.2.8. Use of the “Chat with Provider” Function:

The Client can initiate a conversation with an Accountant for additional questions or to assess collaboration suitability. Only the Client can start a conversation; the Accountant may respond only if the Client initiates it. All participants remain anonymous.

1.3. In addition to these Terms of Use, the relationship between FMA Estonia OÜ and the User is governed by:

• The laws of the Republic of Estonia,

• The http://www.findmyaccountant.eu/en Privacy Policy and Pricing,

• Additional rules governing inquiries and transactions, the Accountant’s own terms and privacy policies (if disclosed to the Client),

• Generally accepted good practices.

2. Service and Content of the Terms of Use:

2.1. Description of the Service:
FMA Estonia OÜ operates the http://www.findmyaccountant.eu/en portal, which enables Users to:

• Submit and manage requests for accounting and/or business consulting services;

• Make and compare offers;

• Select a Request winner;

• Communicate via the portal;

• Use other features according to the portal’s structure and offered service package.

2.2. http://www.findmyaccountant.eu/en is a matching platform, not a service provider. FMA Estonia OÜ does not provide accounting or business consulting services, does not represent Users, and is not authorized to act on their behalf. All declarations and agreements made via the portal are between Users, who are responsible for their content and execution. Relationships between Clients and Accountants are governed by applicable contract law and anti-money laundering and counter-terrorism financing regulations.

3. Rights and Obligations of FMA Estonia OÜ:

3.1.  As the portal operator, FMA Estonia OÜ has the right to:

3.1.1. remove or refuse to publish Requests or Offers submitted to http://www.findmyaccountant.eu/enthat violate these Terms of Use, the law, or good practice;

3.1.2. verify User-submitted information and ensure compliance with Terms of Use, law, or good practices;

3.1.3. restrict or terminate a User’s access to the portal if they violate the law, Terms of Use, or Privacy Policy, or if their actions compromise the credibility of the portal;

3.1.4. require identity verification when registering a User Account and process personal data in accordance with applicable laws and the Privacy Policy;

3.1.5. conduct background checks on Users, including information from sanctions lists, negative media coverage, and other public sources, and deny access to the portal if the User does not meet the risk assessment criteria under FMA Estonia OÜ’s internal AML policies or other objective suitability requirements;

3.1.6. charge the Accountant a fee for using the portal in accordance with the selected service package and to charge a service fee for a won Request, in accordance with the Offer submitted by the Accountant and delivered to the Client, in which the Accountant has separately specified the amount of the service fee and the terms of its payment, as well as any additional terms applicable to the Offer;

3.1.7. if the Client pays for the service directly to the bank account of FMA Estonia OÜ, to withhold the service fee from the amount paid by the Client in accordance with the service fee amount specified by the Accountant in the Offer, the applicable price list, and the terms agreed in the Offer and any additional terms applicable thereto;

3.1.8. suspend the Accountant’s access to the services without prior notice if the service package fee has not been paid;

3.1.9. charge the User a fee amounting to 25% of the value of the Request if it becomes evident that the User has attempted to circumvent the portal’s intermediary fees by communicating with the other party outside the platform;

3.1.10. collect feedback from the Client regarding the Accountant’s work and to display such feedback publicly on the Accountant’s profile on the http://www.findmyaccountant.eu/enweb portal using a five-point rating system;.

3.1.11. restrict or terminate the Accountant’s access to the portal if the Accountant refuses to provide services to the Client without a valid reason;

3.1.12. refuse payments originating from restricted payment regions, as listed at: https://www.cooppank.ee/eraklient/igapaevapangandus/maksed/piiratud-valismaksed 

3.1.13. to use automated analysis of message content in order to detect attempts to enter into agreements outside the portal;

3.1.14. restrict or close a User Account if the Client and the Accountant use the messaging function to agree on cooperation outside the portal and thereby avoid the platform fees;

3.1.15. use automated and data-driven methods, including analysis based on artificial intelligence, to analyse the data entered by the Client and to compare such data with the Accountants’ Service Provider Profiles, for the purpose of forwarding the Request to the Accountants whom FMA Estonia OÜ considers most suitable for the Client;

3.1.16. provide the Client with the Offers that FMA Estonia OÜ considers the best, based on the results of automated and data-driven analysis, taking into account, among other factors, the quality of the Offer, the suitability of the Service Provider profile to the Request, prior feedback, price, and other relevant criteria.

3.2.  FMA Estonia OÜ, as the portal operator, undertakes to:

3.2.1. provide the Client’s contact details (company name and email address) to the Accountant who is the Request Winner immediately after the Client has confirmed the Request Winner;

3.2.2. pay the Accountant who is the Request Winner the amount received as an advance payment for the successfully completed Request, minus the service fee, within five business days, if the payment was made to the bank account of FMA Estonia OÜ;

3.2.3. refund the advance payment to the Client within three business days if the Accountant who is the Request Winner has not contacted the Client within two business days, provided that the payment was made to the bank account of FMA Estonia OÜ;

3.2.4. monitor the technical operation of the portal and promote respectful communication within the platform;

3.2.5. provide Users with customer support via email at info@findmyaccountant.eu;

3.2.6. notify the Client immediately if it becomes evident that the Accountant cannot fulfil the Offer;

3.2.7. notify the Accountant if it becomes apparent that the Client has submitted incomplete or incorrect information;

3.2.8. delete the User Account at the User’s written request, provided that all obligations towards FMA Estonia OÜ have been fulfilled.

4. User Rights and Obligations:
​
4.1. The User undertakes to:

4.1.1. provide only true and up-to-date information that complies with these Terms of Use and applicable law;

4.1.2. not submit or publish false information on the http://www.findmyaccountant.eu/enportal or disparage other Users;

4.1.3. not submit fake Requests or fraudulent Offers;

4.1.4. ensure that all submitted personal and contact details are accurate and valid;

4.1.5. confirm that they have the authority to submit Requests and/or Offers on behalf of the represented legal entity;

4.1.6. keep their account information (including password and unique Inquiry links) secure and immediately notify FMA Estonia OÜ if this information has been accessed by third parties;

4.1.7. not avoid the portal’s service fees, including making an artificially lower Offer to reduce the fees;

4.1.8. agree that FMA Estonia OÜ may, for the purpose of providing better service, display their submitted Requests in other online environments;

4.1.9. pay the applicable fee for the selected service package within 14 days of receiving the invoice;

4.1.10. contact the Client within two business days of winning an Offer;

4.1.11. notify FMA Estonia OÜ if the Accountant who is the Request Winner has not contacted the Client within three business days;

4.1.12. notify FMA Estonia OÜ within three business days after the announcement of the Request Winner if the Accountant is unable to provide the requested service to the Client;

4.1.13. provide FMA Estonia OÜ with a valid bank account for payment of the Offer amount (minus service fee) if the Client pays directly to FMA Estonia OÜ, within five business days;

4.1.14. pay FMA Estonia OÜ a 25% service fee if the Client is not contacted within two business days or if cooperation is refused without valid reason.

4.2. The User has the right to:

4.2.1. receive information and support from customer service via email at info@findmyaccountant.eu;

4.2.2. manage their account, including closing it after fulfilling all obligations towards FMA Estonia OÜ;

4.2.3. use the portal’s features in accordance with the applicable Terms of Use and the selected service package;

4.2.4. submit a request to FMA Estonia OÜ to remove a negative comment or a review for a valid reason, by contacting customer support.

5.Liability:
​
5.1. FMA Estonia OÜ is not liable for any damages arising from the use of the portal or in connection with it if the damage is caused by:

​

• technical failures on the User’s device or connection;

• alteration or deletion of data submitted by the User;

• false or misleading information provided by Users;

• failure of Users to fulfil agreements made between them;

• violation of law by the User

5.2. The User is solely and fully responsible for:

​

• the accuracy of the data and information they submit;

• legal relationships and transactions arising through the use of the portal;

• any damages caused to third parties or to FMA Estonia OÜ due to violation of these Terms of Use or applicable law

6.Validity of the Terms of Use:
​
6.1. These Terms of Use are effective from the moment the User uses the portal http://www.findmyaccountant.eu/enin any form.;

6.2. FMA Estonia OÜ has the right to modify these Terms of Use and the prices related to the services. All changes come into effect upon their publication on the http://www.findmyaccountant.eu/en portal;

6.3. If the User does not agree with the modified Terms of Use, they must immediately cease using the portal. In such a case, FMA Estonia OÜ may restrict the User’s access to the services.
 
7. Personal Data and Its Processing:

The User agrees that their personal data will be processed in accordance with applicable law and the FMA Estonia OÜ Privacy Policy.
By agreeing to these Terms of Use, the User confirms that they have read the Privacy Policy and consent to the processing of their personal data as described therein.

8.Final Provisions:
​
8.1. FMA Estonia OÜ and the User will attempt to resolve any disputes first through negotiation. If an agreement cannot be reached, the dispute will be settled in accordance with the laws of the Republic of Estonia.

8.2. These Terms of Use come into effect from the moment the User agrees to them.

8.3. By agreeing to the Terms of Use, the User confirms that they have read and understood the terms and agree to comply with them.
