Terms of Service

Please read these terms carefully before using our website.

1. General Provisions:

1.1. These Terms of Use govern the legal relationship between the User and FMA Estonia OÜ (registry code 16957616) arising from the use of the findmyaccountant.eu portal.

1.2. Terms and definitions used in these Terms of Use:

1.2.1. findmyaccountant.eu:

findmyaccountant.eu is an online portal owned by FMA Estonia OÜ that enables Users to submit, make, and compare requests and offers related to accounting and/or business consulting services, to select a winning offer, and to communicate with each other.

Users can act both as service requesters (Clients) and service providers (Accountants). In addition to submitting offers, Accountants can manage inquiries, and—depending on the selected subscription plan—increase their company’s visibility and advertising presence.

1.2.2. User:

A User is a natural or legal person who uses the findmyaccountant.eu portal. Users are divided into two categories:

  • Client – A User who submits requests on the portal to receive accounting and/or business consulting services;

  • Accountant – legal entity that has registered a User Account and submits offers in response to Client requests.

 

1.2.3. User Account:

A User Account is an account created on the findmyaccountant.eu portal through which the Accountant can manage their company profile, respond to requests, and use other portal functions.

To register an account, the Accountant must provide the company name, registry code, VAT number (if applicable), address, contact phone number, and email address. In the account settings, the Accountant can describe the services offered and select the types of inquiries they wish to receive notifications about.

1.2.4. Request:

A request is a consolidated request created by the Client based on submitted information, preferences, and conditions. All interested Accountants can submit offers for accounting and/or business consulting services in response to the Inquiry, under terms defined by the Accountant.

1.2.5. Offer:

An Offer is a price quote submitted by the Accountant in response to the Client’s Request. The conditions of the Offer are determined by the Accountant.

1.2.6. Request Winner:

The Request Winner is the Accountant whose Offer has been selected and confirmed by the Client.

1.2.7. Use of the “Chat with Provider” Function:

For each Request, the Client can initiate a conversation with the Accountant to ask additional questions or assess the suitability of potential cooperation. Only the Client can initiate the chat; the Accountant can reply only if the Client has started the conversation. 

1.3. In addition to these Terms of Use, the relationship between FMA Estonia OÜ and the User is also governed by:

  • The laws of the Republic of Estonia,

  • The findmyaccountant.eu Privacy Policy and Pricing,

  • Additional rules governing inquiries and transactions, the Accountant’s own terms and privacy policies (if disclosed to the Client),

  • Generally accepted good practices.

 

2. Scope of Service and Content of the Terms of Use:

2.1. Description of the Service:

FMA Estonia OÜ operates the findmyaccountant.eu portal, which enables Users to:

  • submit and manage requests for accounting and/or business consulting services,

  • make and compare offers,

  • select the winning offer,

  • communicate via the portal,

  • use other features according to the structure of the portal and the selected service package.

2.2. findmyaccountant.eu is a matchmaking portal, not a service provider. FMA Estonia OÜ does not itself provide accounting or business consulting services, does not represent the User, and is not authorized to act on their behalf.

All declarations of intent and contracts made through the portal are established between Users, who are solely responsible for their content and fulfillment.

Accountants and Clients must take into account that their legal relationship is governed by the Law of Obligations Act and the Money Laundering and Terrorist Financing Prevention Act.


 

3. Rights and Obligations of FMA Estonia OÜ:

3.1.  As the portal operator, FMA Estonia OÜ has the right to:

3.1.1. not publish or remove Requests or Offers submitted to findmyaccountant.eu if they violate the Terms of Use, applicable law, or good practices;

3.1.2. review the information submitted by the User and verify its compliance with the Terms of Use, applicable law, or good practices;

3.1.3. restrict or terminate a User’s access to the portal if they violate the law, Terms of Use, or Privacy Policy, or if their actions compromise the credibility of the portal;

3.1.4. require identity verification when registering a User Account and process personal data in accordance with applicable laws and the Privacy Policy;

3.1.5. conduct background checks on Users, including information from sanctions lists, negative media coverage, and other public sources, and deny access to the portal if the User does not meet the risk assessment criteria under FMA Estonia OÜ’s internal AML policies or other objective suitability requirements;

3.1.6. charge a fee from the Accountant for using the portal based on the selected service package and, where the Client pays for the service directly to FMA Estonia OÜ, retain a service fee from the payment amount in accordance with the valid price list;

3.1.7. suspend an Accountant’s access to services without prior notice if the service package fee has not been paid;

3.1.8. charge the User a fee of 15% of the Inquiry value if it is discovered that the User has attempted to bypass the portal’s service fees by communicating with the other party outside the platform;

3.1.9. collect feedback from Clients regarding the Accountant’s work and display it publicly on the Accountant’s profile within the findmyaccountant.eu portal using a 5-star rating system.

3.1.10. restrict or terminate an Accountant’s access to the portal if they refuse to serve a Client without a valid reason;

3.1.11. reject payments originating from restricted jurisdictions: https://www.cooppank.ee/eraklient/igapaevapangandus/maksed/piiratud-valismaksed 

3.1.12. use automated analysis of chat content to detect attempts to make arrangements outside the portal;

3.1.13. restrict or close a User Account if a Client and Accountant use the chat function to arrange cooperation outside the portal and thereby avoid the platform fee;

3.2.  FMA Estonia OÜ, as the portal operator, undertakes to:

3.2.1. forward the Client's contact details (company name and email address) to the winner of the Inquiry immediately after the winner is selected;

3.2.2. transfer the payment received in advance (minus the service fee) to the Accountant for a won Offer within five business days, if the payment was made to FMA Estonia OÜ’s account;

3.2.3. refund the advance payment to the Client within three business days if the winning Accountant has not contacted the Client within two business days, provided that the payment was made to FMA Estonia OÜ’s account;

3.2.4. monitor the technical functionality of the portal and promote respectful communication within the platform;

3.2.5. provide customer support to Users via email at info@fmaestonia.com;

3.2.6. notify the Client immediately if it becomes evident that the Accountant cannot fulfill the Request;

3.2.7. notify the Accountant if the Client has submitted incomplete or incorrect information;

3.2.8. delete a User account upon written request, provided all obligations to FMA Estonia OÜ have been fulfilled.

 

4. Rights and Obligations of the User:

4.1. The User agrees to:

4.1.1. provide only truthful and up-to-date information in accordance with these Terms of Use and applicable law;

4.1.2. not transmit or publish false information or defame other Users on the findmyaccountant.eu portal;

4.1.3. not submit fake Requests or fraudulent Offers;

4.1.4. ensure that all submitted personal and contact details are accurate and valid;

4.1.5. confirm that they have the authority to submit Requests and/or Offers on behalf of the represented legal entity; 

4.1.6. keep their account information (including password and unique Inquiry links) secure and immediately notify FMA Estonia OÜ if this information has been accessed by third parties;

4.1.7. not attempt to circumvent the portal’s service fees, including by entering into agreements outside the platform after winning an Offer;

4.1.8. consent that FMA Estonia OÜ may, for service improvement purposes, display their Inquiries on other online platforms;

4.1.9. pay the applicable fee for the selected service package within 14 days of receiving the invoice;

4.1.10. contact the Client within two business days of winning an Offer;

4.1.11. notify FMA Estonia OÜ if the winning Accountant has not contacted the Client within three business days;

4.1.12. notify FMA Estonia OÜ within three business days after the winner is announced if the winning Accountant is unable to serve the Client;

4.1.13. provide FMA Estonia OÜ with a valid bank account to which the payment (minus service fee) for a won Offer will be made, within five business days, if the Client paid FMA Estonia OÜ directly;

4.1.14. pay a 2.5% service fee to FMA Estonia OÜ if the winning party fails to contact the Client within two business days or declines the assignment without valid reason. 

4.1.15. Offers must remain valid for at least seven (7) working days after the request deadline.

4.2. The User has the right to:

4.2.1. receive information and assistance from customer support via info@fmaestonia.com;

4.2.2. manage their account, including closing it after fulfilling all obligations to FMA Estonia OÜ;

4.2.3. use the portal's features in accordance with the valid Terms of Use and the selected service package;

4.2.4. request the removal of a negative review for valid reasons by contacting FMA Estonia OÜ customer support.

 

5. Liability:

5.1. FMA Estonia OÜ is not liable for any damages arising from or in connection with the use of the portal if the damage is caused by:

  • technical malfunctions in the User’s device or connection;

  • modification or deletion of data entered by the User;

  • false or misleading information provided by Users;

  • failure by Users to fulfill their mutual agreements;

  • violations of the law by the User.

5.2. The User is independently and fully liable for:

  • the accuracy of the data and information they provide;

  • legal relationships and transactions arising from the use of the portal;

  • any damage caused to third parties or to FMA Estonia OÜ due to a violation of the Terms of Use or applicable law.

 

6. Validity of the Terms of Use:

6.1. The Terms of Use take effect from the moment the User uses the findmyaccountant.eu portal in any form; 

6.2. FMA Estonia OÜ has the right to amend the Terms of Use and prices related to the services. All changes take effect upon publication on the findmyaccountant.eu webportal;

6.3. If the User does not agree with the amended Terms of Use, they must immediately stop using the portal. In such a case, FMA Estonia OÜ may restrict the User’s access to services. 


 

7. Personal Data and Its Processing:

The User agrees that their personal data will be processed in accordance with applicable law and FMA Estonia OÜ’s Privacy Policy. By accepting the Terms of Use, the User confirms they have read and agreed to the Privacy Policy. 


 

8. Final Provisions:

8.1. FMA Estonia OÜ and the User shall first attempt to resolve any disputes through negotiation. If no agreement is reached, the dispute will be resolved under the laws of the Republic of Estonia;

8.2. The Terms of Use enter into force once the User has accepted them;

8.3. By accepting the Terms of Use, the User confirms they have read, understood, and agreed to comply with them.
